Sy tak berpengetahuan luas dalam bidang perundangan. But justice as we know today, it just really breaks my heart. Sy baru siap researching on media laws in Malaysia. I can tell you allllllllllllll about media laws from the top of my head.. termasuk semua kes-kes berkaitan akta media dari tahun 1970an sampai sekarang. Hehehe..
Kes Altantuya, finale nya adlah hukuman gantung kepada Sirul & Azilah. Now, we all dah tahu how ridiculous the charges are. Mereka mungkin pembunuh, and deserves whatever punishment coming their way, tapi saya tak rasa diorang harus pikul laknat orang lain. Dalam undang2, we had what we called, 'burden of proof'.. Meaning, kalau anda tuduh seseorang, u kena datangkan bukti. Beban bukti jatuh ke atas bahu si penuduh. In this case, the prosecution atau pihak pendakwaraya.
Jom rewind sikit. I faham dari kes ni, burden of proof is achieved when the case is transpired as a prima facie. Now, there is a burden of assumption, lies on the shoulder of the defence. Pendek cerita, it is up to the defence to cast a shadow of doubt over the case for at least a dismissal or retrial.
To cast a shadow of doubt, org bodoh pun boleh fikir. Brapa banyak shadow kes Altantuya ni ada? Let start counting:
1. Motif?
2. Connection with the victim?
3. Evidence of C4 exist, but is there evidence on how those two gain access to the stuff?
4. Who else?
Semua ni sepatutnya casting shadows on the burden of assumptions on the case. If saya lawyer, I takkan buang masa on evidence, but I will try to shift the burden of assumption towards the prosecution. Hence, the prosecution has to come up with motives and how they connect the dots.
This case make me sick. Hope u ppl burn in hell for all the bad things u done.
